Terms of service
Plain terms for a service whose entire value is being trustworthy. Where a clause would normally be written to protect us at your expense, we have tried to write what we would actually defend.
The agreement
These terms are between you (the customer organization) and EAACompliance.org, The Bradfield Centre, Cambridge Science Park Road, Cambridge, CB4 0GA, United Kingdom. They apply when you create an organization on eaacompliance.org, whether or not you pay us.
What we provide
- Automated scanning of web pages on domains you have verified, against WCAG 2.1 level A and AA.
- A coverage matrix recording, per success criterion, what was tested and by which method.
- An append-only ledger of verifications, scans, sign-offs and exports.
- Generated documents: conformance report, accessibility statement and regulator response pack.
- An API and webhooks on plans that include them.
What we do not claim
We also do not promise that a clean scan means an accessible site. Automated testing detects the presence of defects reliably; it cannot prove their absence for every user, assistive technology and journey.
Your responsibilities
- Scan only domains you own or are authorized to test. Domain verification exists to make that provable, and circumventing it is a breach of these terms.
- Keep API keys and webhook secrets confidential; treat a leaked key as you would a leaked password and revoke it.
- Install the journey recorder only in browsers whose users know it is there, and only for the audit work it is meant for.
- Do not use the service to attack, overload or map infrastructure you do not control.
Capacity and plans
Plans are metered by pages scanned per month across all your domains, at the frequency your plan allows. Domains and subdomains are unlimited within that capacity.
When you reach your capacity for a period, scheduled scans reduce to the lowest frequency your plan allows rather than stopping, and the reduction is recorded in your ledger. Verification, journeys, exports and your evidence remain fully available. Upgrades take effect immediately and are prorated; downgrades take effect at the end of the paid period.
Payment
Subscriptions are billed in advance through Stripe, in euro, excluding VAT. If a payment fails we will tell you and keep scanning for 14 days; after that scanning pauses, but your evidence file, ledger and exports remain accessible. We do not hold compliance evidence hostage to an invoice.
Your data and evidence
Your scan results, coverage matrix and ledger are yours. You can export them at any time in full. We process them as your processor under our data processing agreement, which forms part of these terms.
Deleting your organization is a request we confirm with you rather than an instant, irreversible action, precisely because the thing being deleted is evidence you may later need.
Availability
We publish our own uptime and every incident at /status, including the ones nobody reported. Where an incident prevented a scheduled scan, a system entry is written into your ledger so the gap is explainable rather than mysterious. We do not offer a contractual uptime guarantee at these prices, and we would rather say that than bury an unenforceable SLA in an annex.
Liability
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability in any twelve-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential loss.
We are not liable for the accessibility of your website, for fines or claims arising from it, or for decisions you take on the basis of our reports. We are liable for providing the service described here with reasonable skill and care.
Ending the agreement
You may cancel at any time; cancellation takes effect at the end of the paid period and your data stays available on the free tier afterwards. We may suspend an account for non-payment after the grace period, or immediately for scanning domains you are not authorized to scan.
Law
These terms are governed by the laws of England and Wales, with the courts of England and Wales having exclusive jurisdiction. If you contract with us as a consumer, this does not deprive you of protections you have under the mandatory law of your country of residence.
